Learners will be empowered with the knowledge and skills to:
- Determine when discrimination in employment arises, including:
- An understanding of personal characteristics protected by the BC Human Rights Code
- What constitutes adverse impact
- Defences available to respond to a complaint of discrimination
- Understand the fundamental Employer responsibilities arising under the duty to accommodate
- Navigate the key procedural components of the duty to accommodate process
- Successfully recognize and fulfill the duty to inquire
- Recognize some of the more complicated human rights issues involving return to work and the potential intersection between workplace misconduct and disability
- Key considerations in determining when the duty to accommodate comes to an end including the factors considered when assessing undue hardship.
